AUTO UNINSURED AND UNDERINSURED COVERAGE REQUIREMENTS

(September, 2007)

Uninsured Motorists (UM) coverage compensates an insured for bodily injury suffered in an accident. The injury must be caused by a driver operating an uninsured vehicle. This coverage is subject to stated limits. Minimum basic limits of liability for UM coverage appear in the financial responsibility law of the state where the motor vehicle is registered. Higher limits of UM coverage may be requested. Another option for drivers desiring adequate protection is Underinsured Motorists (UIM) coverage. This compensates an insured for bodily injury caused by a driver who carries minimum or very low limits of insurance.

This protection is available in all personal automobile liability policies and is mandatory in many states. While UM coverage must be offered in connection with auto liability insurance, in some states, the insured has the right to reject the coverage. In those states that permit drivers to reject coverage, the choice is made via different methods (such as having to reject the coverage in writing). The protection is modified in some states according to legislative requirements, notably in those states with "no-fault" or auto reparation systems.

What follows is a brief recap of which states offer or require uninsured motorists coverage and the minimum limits that must be offered.

Note: This is merely intended as a general reference. Please be sure to verify what applies in a particular state rather than strictly relying on what appears below.
