Where is the coverage?

Donald decided to pass William. William didn't like it so he sped up and passed Donald. The two played tag with their tractor-trailer units for quite a while until William dangerously cut off Donald, Donald then radioed William and requested that they talk. William pulled over to the shoulder and Donald pulled in behind him. Donald exited his vehicle but William suddenly pulled back onto the highway.

Unfortunately, John and his wife were in William's way. John attempted to avoid William but crashed into an embankment. His wife died and John was seriously injured. A number of lawsuits ensued including one against Donald's employer trucking company. Donald's auto insurer defended and paid the employer's portion of the loss. It then pursued the CGL carrier because it argued that Donald was the problem … not Donald's truck!

The courts agreed because Donald was not in or on his vehicle at the time of the accident.

More than just a truck

Trucking operations are more than just a guy with a truck. Tractor-trailer units are very expensive. The regulations they operate under are complex, and the relationships between the truck line and its drivers are very individualized. The agent who wants to pursue this very lucrative class of business must be aware of the challenges it presents.

Correct premiums start with correct classifications

This court case demonstrates why truck lines need CGL coverage. This coverage can be relatively inexpensive if it is property classified, because the classification does not include the payroll for the most expensive employees in the basis of premium.

What about independent operators?

Many truck lines hire independent operators instead of employees. They provide the auto insurance for the independent but only while that operator hauls cargo for the truck line. Do you have a client who might operate a vehicle on either a deadhead or bobtail basis?
