MCI strongly encouraged its employees to participate in a number of fun activities. The activities took place on premises and during working hours. Participation in the activities along with sales performance was considered in determining employee bonuses.
Edith was injured during a dance contest activity and submitted a workers compensation claim.
MCI denied her workers compensation demand because dancing was not within the scope of her normal activities as a sales representative.
Even though the Kansas Administrative Law Judge repeatedly agreed with Edith, MCI continued to appeal the ruling until the Kansas Court of Appeals made a final decision.
