Dancing for dollars

MCI strongly encouraged its employees to participate in a number of fun activities. The activities took place on premises and during working hours. Participation in the activities along with sales performance was considered in determining employee bonuses.

Edith was injured during a dance contest activity and submitted a workers compensation claim.
MCI denied her workers compensation demand because dancing was not within the scope of her normal activities as a sales representative.

Even though the Kansas Administrative Law Judge repeatedly agreed with Edith, MCI continued to appeal the ruling until the Kansas Court of Appeals made a final decision.

Kansas or California

The Workers Compensation Policy is unique because it does not contain key coverage information. Each state’s workers compensation law dictates the scope of coverage provided and has its own administrative boards to respond to coverage challenges.

A coverage every employer needs

Since workers compensation coverage is mandatory for most employers, it can be an entry point to use in prospecting  for new clients. Identifying and then solving workers compensation problems can position you to write the rest of a client’s business.

Mistakes can happen

Errors and omissions can and do take place when workers compensation coverage is sold and serviced. Before starting a workers compensation campaign, it is important to be familiar with your particular state’s law as well as the laws in surrounding states. PF&M is an excellent resource to use to identify exposures and available endorsements. In addition, the Rough Notes magazine has numerous articles on this subject.
