Documentation and permissive use

Herbert's daughter was a student nurse who lived with her parents when she was not attending college. One day, Herbert was close to the campus while using his company car and he arranged to pick her up to bring her home. An accident occurred and Herbert's daughter sued her father's employer for her injuries.

This classic case asked the courts to determine when the employee stopped using his employer's car with permission.

Back to the basics

The first and most basic question on any commercial liability policy is "who is the insured." The answer is the starting point in both underwriting and claims handling. If the person or entity is not an insured, there is no coverage for damages they cause.

Identifying and solving a problem

As in this court case, some employers do not permit employees to use their company-supplied vehicles for any purpose other than company business. However, many employers and employees consider a company-owned vehicle an employee perk, and the employee uses the vehicle for both business and pleasure, with the employer's permission. In some cases, this results in an employee not having a personal auto policy.

Taking a different approach

Have you considered leading with your commercial auto product? It often produces the largest premium of all policies in a portfolio and is still treated as an afterthought. If an owner currently insures all his vehicles on the business auto policy and does not have a personal auto policy, you might discover a gap in coverage that could move the entire account to you.
