A hired problem

R. Squared Enterprises employed Kimberly to help Dennis Pinto who had dementia. The day after she was hired, she drove the Pinto family auto to a restaurant so she and Dennis could have lunch. Kimberly left the restaurant intoxicated and drove the vehicle into a tree, causing serious injuries to Dennis. It was later discovered that this was Kimberly's third alcohol-related offense.

The Pinto family sued R. Squared Enterprises. R .Squared requested coverage from both its auto and CGL carriers. One carrier defended and paid but the other refused.

Taking on new responsibilities

Many working adults take on the responsibility of caring for a spouse, parent, or adult child with dementia or some other condition that limits them. These caregiver adults become the advocates and, as such, must make many decisions regarding care. In the Pinto case, a caregiver came into the home. Other families choose Adult Day Care Centers.
